(Carson City, NV; April 2, 2012) — Secretary of State Ross Miller issued an emergency regulation, signed by Governor Brian Sandoval, for the candidate nominating process in preparation of the upcoming vacancy in Department 4 of the Eighth Judicial District Court.
The emergency regulation states that interested parties must complete a candidate nominating petition and gather 761 signatures of registered voters (one percent of the number of persons who voted for the office in Clark County at the last general election in which the office was on the ballot). Circulation of a nominating petition for Department 4 of the Eighth Judicial District Court may begin on the date of adoption of the emergency regulations and must be filed with the Clark County Registrar of Voters by 5 p.m. on May 21, 2012.
While NRS 293.165(3) details a specific time period for a nonpartisan vacant seat to appear on the next general election ballot, it does not provide direction for the Secretary of State’s office to process candidate nominations when no primary election will be held for the seat. The emergency regulation set forth by the Secretary of State’s office does not govern any other judicial vacancy than Department 4 of the Eighth Judicial District Court during the 2012 election.
